1. Acceptance of Terms

By accessing or using PixList ("the Service"), operated by OpenNova LLC at pixlist.org, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including free and paid subscribers.

2. Description of Service

PixList is an AI-powered platform that helps users create eBay listings from photos. Users upload a photo of an item, and PixList uses artificial intelligence to generate a complete listing including title, description, pricing based on market data, and relevant item details. Users can then review, edit, and post listings directly to their connected eBay account.

3. Account Registration

To use PixList, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must be at least 18 years old to create an account and use PixList.

4. Subscription Plans & Billing

PixList offers the following subscription tiers:

  • Free — 1 listing per month
  • Starter ($9.99/month) — 20 listings per month
  • Pro ($29.99/month) — 50 listings per month
  • Max ($99.99/month) — Unlimited listings

Paid subscriptions are billed monthly through Stripe. You may cancel at any time. Cancellation takes effect at the end of your current billing period — you will retain access until then. No refunds are provided for partial months.

We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified via email before any price change takes effect.

5. eBay Account Connection

To post listings, you must connect your eBay account via OAuth. By doing so, you authorize PixList to create and manage listings on your behalf. You are solely responsible for the content of listings posted to your eBay account, including accuracy of descriptions, pricing, and compliance with eBay's policies.

You may disconnect your eBay account at any time from your PixList dashboard settings. Disconnecting will prevent PixList from posting new listings but will not affect existing listings on eBay.

6. AI-Generated Content

Listings generated by PixList are created using artificial intelligence. While we strive for accuracy, AI-generated titles, descriptions, pricing, and item details are suggestions and may contain errors. You are responsible for reviewing and editing all listings before posting them to eBay.

PixList is not responsible for inaccurate listings, incorrect pricing, or any disputes arising from listings posted to eBay. Always verify AI-generated content before publishing.

7. User Content & Photos

You retain ownership of all photos you upload to PixList. By uploading photos, you grant PixList a limited license to process, store, and transmit those photos solely for the purpose of generating listings and providing the Service.

You agree not to upload content that is illegal, infringes on intellectual property rights, or violates any applicable laws. We reserve the right to remove content that violates these terms.

8. Acceptable Use

You agree not to:

  • Use PixList for any unlawful purpose
  • List counterfeit, stolen, or prohibited items
  • Attempt to reverse-engineer, decompile, or extract source code from PixList
  • Use automated tools to scrape or abuse the Service
  • Share your account credentials with others
  • Circumvent listing quotas or subscription restrictions

Violation of these terms may result in immediate account suspension or termination without refund.

9. Limitation of Liability

PixList is provided "as is" without warranties of any kind, express or implied. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to lost profits, lost sales, or data loss. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless PixList, its owners, and affiliates from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your listings on eBay, or your violation of these Terms.

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to PixList. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any downtime or service interruptions.

12. eBay Account Responsibility

You are solely responsible for the status and standing of your eBay account. PixList generates listings using AI as suggestions only. If a listing posted through PixList results in an eBay policy violation, account restriction, or suspension, PixList is not liable. It is your responsibility to review all content before posting and ensure compliance with eBay's policies.

13. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of PixList shall be resolved through binding individual arbitration, rather than in court. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against PixList.

Arbitration shall be conducted under the rules of the American Arbitration Association (AAA). The arbitration shall take place in Lafayette County, Mississippi. Each party shall bear its own costs unless the arbitrator determines otherwise.

14. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Data deletion will follow our Privacy Policy.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, for significant changes, by email. Continued use of PixList after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the State of Mississippi, United States. Any disputes arising from these Terms shall be resolved in the courts of Lafayette County, Mississippi.

17. Third-Party Trademarks & eBay Disclaimer

PixList is an independent tool operated by OpenNova LLC. PixList is not affiliated with, endorsed by, or sponsored by eBay Inc.eBay® is a registered trademark of eBay Inc., used here for descriptive purposes only to identify the marketplace PixList integrates with via eBay's public developer APIs.

All other product names, logos, brands, and trademarks referenced within PixList or within AI-generated listings are the property of their respective owners. Use of these names does not imply any affiliation with or endorsement by their respective holders.
